1. Agreement to Terms

By accessing or using Attyre ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including the mobile application and web services.

2. Description of Service

Attyre provides AI-powered wardrobe and outfit services that:

• Extract clothing items from your photos — fit pics, flat lays, closet shots, or single-item photos — to build a digital wardrobe
• Organize your wardrobe by category, color, style, occasion, and season
• Generate outfit ideas and combinations from your own clothes, tailored to occasion, weather, and your preferences
• Provide daily outfit recommendations based on the weather in your area
• Let you save favorite outfits, rate generated looks, and train your personal AI to better match your taste
• Offer an optional face card feature that generates style insights (facial feature attributes, suited colors, celebrity style twins) from a regular photo of your face

3. User Accounts

Attyre does not require you to create an account or provide an email address. We identify your device with a randomly generated, anonymous identifier that is stored securely on your device.

Eligibility

• You must be at least 13 years old to use the Service
• You must provide accurate and truthful answers during onboarding
• You must not use the Service if your access has been previously terminated

Device Responsibilities

You are responsible for:

• Maintaining the security of your device and its passcode, Face ID, or Touch ID
• All activity that occurs through your device's access to the Service
• Notifying us immediately if you believe your device has been compromised or your data accessed without authorization

You agree not to:

• Use another person's device identity or impersonate another user
• Create multiple device registrations for deceptive purposes
• Use the Service for any illegal or unauthorized purpose

4. Acceptable Use Policy

You agree NOT to:

• Upload photos that are not yours or that you do not have the right to share
• Upload photos of other people without their permission
• Upload inappropriate, offensive, or illegal content
• Use the Service to harass, abuse, or harm others
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated systems or bots to access the Service
• Violate any applicable laws or regulations
• Infringe on any third-party rights
• Transmit viruses or malicious code
• Interfere with or disrupt the Service or its servers

5. Content and Intellectual Property

Your Content

By uploading photos or other content to Attyre, you:

• Retain ownership of your content
• Grant us a license to use, process, store, and analyze your content solely to provide the Service to you
• Confirm you have the right to upload and share the content
• Understand that your photos may be transmitted to our third-party AI service providers to generate parts of your experience. Under our agreements with them, your data is not used to train their models. See the AI Processing section of our Privacy Policy for details.
• Understand that aggregate, anonymized metrics may be used to improve the Service. We do not use your photographs to train our own models without your separate, explicit opt-in.

Our Content

All Service content, features, designs, trademarks, and functionality are owned by Attyre and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

6. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using Attyre, you consent to our collection and use of personal information as outlined in the Privacy Policy, including the storage and AI processing of the photos you upload.

7. Disclaimers and Limitations

Service Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy or reliability of outfit suggestions or item extraction
• Uninterrupted or error-free service
• Fitness for a particular purpose
• Non-infringement of third-party rights

8. Limitation of Liability

To the maximum extent permitted by law, Attyre shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or use
• Damages resulting from unauthorized access to your device or data
• Any damages exceeding the amount paid by you to us in the past 12 months

9. Indemnification

You agree to indemnify and hold harmless Attyre, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content uploaded to the Service

10. Subscription and Payments

Attyre offers two auto-renewing subscription plans: a weekly plan and a discounted yearly plan. An active subscription unlocks the full features of the Service.

• Billing occurs at the beginning of each subscription period through the App Store
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• Any free trial availability and its terms, where offered, are shown on the purchase screen for your platform and region
• The purchase screen shows the authoritative price, billing period, and renewal terms for your region
• Cancellation must occur before the renewal date; you can cancel anytime from the account menu in the app or in your Apple ID subscription settings
• No refunds for partial subscription periods
• We may change pricing with 30 days' notice; price changes are handled through the App Store

All payments are processed by Apple. We do not store your payment information.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for:

• Violation of these Terms
• Illegal or harmful activities
• At our sole discretion for any reason

Upon termination, your right to use the Service will cease immediately.

You can delete your account and all associated data at any time: open Attyre, tap the account icon in the top-right corner of the home screen, and choose Delete Account. If you cannot access the app, email hello@attyre.pro with "Data Deletion Request" in the subject line. Deletion is completed within 30 days.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.

15. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Attyre
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect
• Waiver: Failure to enforce any right or provision shall not be deemed a waiver
• Assignment: You may not assign these Terms without our prior written consent
